GENERAL TERMS AND CONDITIONS (GTC)

1. Scope and general

These General Terms and Conditions (GTC) apply to all orders and contracts concluded with consumers via the online shop revitera.ch of Alparis GmbH, Müligässli 1, 8598 Bottighofen, Switzerland (hereinafter “Alparis” or “we”).

The online shop is aimed at consumers residing in Switzerland, Liechtenstein, Germany and other countries in the European Union, provided we offer delivery to the respective country. There is no sale to commercial resellers.

By placing an order you agree to these terms and conditions. Differing customer conditions do not apply unless we have expressly agreed to their validity in writing.

Note: The provisions of these General Terms and Conditions and the mandatory legal regulations apply exclusively to the purchase of our products. If individual provisions of these General Terms and Conditions are ineffective, the validity of the remaining provisions remains unaffected (see also Section 13 Final Provisions).


2. Offer and conclusion of contract

The display of the products in our online shop does not represent a legally binding offer, but rather a non-binding invitation to order. You can select products from our range and collect them using the “Add to shopping cart” button. You can check your entries in the shopping cart. During the ordering process, you enter the required personal data and select shipping and payment methods. Before sending the order, you have the opportunity to check all information and correct it if necessary.

By clicking on the “Buy now” button (or a corresponding button for a payment order) you place a binding order for the goods contained in the shopping cart. Immediately after submitting your order, you will receive an automatic order confirmation from us by email, which confirms receipt of your order and lists its details. This order confirmation does not constitute acceptance of the contract, but simply informs you that we have received your order.

A purchase contract is only concluded when we confirm your order with an express order confirmation by email or at the latest when we dispatch the goods to you. If, in exceptional cases, an ordered item is not available or we cannot accept your order, we will inform you within a reasonable period of time and of course refund any payments already received.

Please make sure that the email address you provide is correct and that you can receive emails from us. Also check your spam folder. If you have not received an order or shipping confirmation from us within 24 hours of placing your order, please contact us.


3. Prices and payment terms

All prices in our online shop are final prices including the applicable statutory VAT. For customers in Switzerland, prices are shown in Swiss francs (CHF). For customers in Germany and the EU, prices are displayed in euros (EUR). Any additional shipping costs incurred will be clearly shown in the ordering process and on our shipping information page.

Price changes and errors in pricing remain reserved. The price at the time of ordering is decisive.

We offer the following payment methods, if available during the ordering process: Credit card (via Shopify Payments/Stripe), PayPal, Apple Pay, Google Pay, Twint (Switzerland only), Klarna (e.g. purchase on account or installment payment; if Klarna is selected, the terms and conditions of Klarna Bank AB also apply; Klarna carries out an identity and creditworthiness check) as well as other methods displayed in the shop. Klarna and Twint are only available for one-off orders, not for subscriptions. Unless otherwise agreed, payment is due immediately upon ordering.

Payment processing: Payment processing is carried out via the respective service providers (Stripe/Shopify Payments, PayPal, Twint - see data protection declaration). Alparis itself does not store any credit card or account data, but only receives confirmation of the payment from the payment services. If payment is refused or fails, we are not obliged to deliver.

Alparis reserves the right to exclude certain payment methods or to demand advance payment in individual cases. Late payment occurs if the payment is not made despite the due date and reminder. Legal consequences of default remain reserved.


4. Delivery and shipping conditions

Delivery area

We deliver our products to Switzerland, Liechtenstein and Germany. Deliveries to other countries are possible as long as the delivery country can be selected in the shop. Unfortunately, we cannot fulfill orders to countries to which we do not deliver. Delivery will be made to the delivery address you provided.

Shipping service providers and delivery times

Switzerland and Liechtenstein: Delivery is usually carried out by Swiss Post. In-stock items will be shipped on the same or following business day and will typically arrive within 1-2 business days of ordering and receiving payment.

Germany: Delivery is usually carried out by DHL or a comparable parcel service. In-stock items typically ship within 1-2 business days and arrive within 2-4 business days of ordering and receiving payment. Delivery takes place from our warehouse in Germany.

Information on delivery times is non-binding unless, in exceptional cases, a binding delivery date has been promised in writing. If an item is not immediately available, we will inform you. Partial deliveries are permitted if this is reasonable for you; We will bear any additional shipping costs incurred as a result.

You will receive a shipping confirmation by email with a tracking number as soon as the goods leave our warehouse.

Shipping costs

Switzerland and Liechtenstein: Free shipping for orders over CHF 75. Below this amount, a flat rate shipping fee applies (the amount can be seen in the checkout).

Germany: Free shipping for orders over EUR 75.00. Below this amount there is a flat shipping fee of EUR 4.95. Shipping costs are subject to change; The currently valid shipping costs will be displayed in the checkout before the order is completed.

Transfer of risk

For customers in Switzerland and Liechtenstein: When the goods are handed over to the shipping service provider, the benefits and risks are transferred to the customer, to the extent permitted by law. Please notify us immediately if shipments arrive damaged.

For customers in Germany and the European Union: The risk of accidental loss and accidental deterioration of the goods only passes to the customer when the goods are handed over to the customer.

We pack the goods carefully. Your statutory warranty claims in the event of transport damage or loss remain unaffected.

Pickup is not planned.


5. Retention of title

The delivered goods remain the property of Alparis until the purchase price has been paid in full. Ownership of the goods is only transferred to you after payment has been made.


6. Right of withdrawal for consumers in the European Union

Consumers residing in the European Union have a statutory right of withdrawal of 14 days. The details can be found in our cancellation policy, which can be viewed at https://www.revitera.ch/policies/refund-policy and is part of these general terms and conditions.

Customers in Switzerland have no legal right of withdrawal for online purchases. However, all customers - regardless of their place of residence - have access to our voluntary 90-day money-back guarantee (see section 7), which goes far beyond the statutory right of withdrawal.


7. 90-day money-back guarantee

We stand behind the quality of our products. If you are not satisfied with a product or are dissatisfied for any other reason, you can make use of our money-back guarantee within 90 days of receiving the goods. In this case, we will refund you the full purchase price (excluding paid shipping costs) - without any ifs or buts.

Procedure of utilization

Contact: Report your request for a refund within 90 calendar days of receiving your order by email to hallo@revitera.ch, stating your order number.

Return:

  • Customers in Switzerland/Liechtenstein: Please send the goods to: Alparis c/o Cross Border Fulfillment GmbH, Blumenfeldstrasse 16, 9403 Goldach, Switzerland

  • Customers in Germany/EU: Please send the goods to: Alparis c/o Agro-Norm Vertriebs GmbH, Am Industriepark 1a, D-84453 Mühldorf, Germany

  • Exceptional cases: If a return does not make sense (e.g. because the product has already been opened or has been completely used up), we can instead allow disposal against appropriate evidence (e.g. photo of the emptied packaging).

Refund: After receipt and inspection of the returned goods or proof of disposal, we will refund you the amount using the payment method used during purchase. The processing time is usually a few working days.

Restrictions

  • The 90-day money-back guarantee can only be used once per customer and only for the first order.
  • We reserve the right to reject further refund requests if it becomes apparent that the guarantee offer is being misused.
  • For subscriptions, this guarantee applies exclusively to the first delivery of the subscription (see Section 9.8); After receipt of the second subscription delivery, a claim is excluded.

Voluntary service

This 90-day money-back guarantee is a voluntary additional service from Alparis GmbH and exists independently of and in addition to your legal rights (in particular the statutory right of withdrawal for EU consumers and the statutory warranty rights). This warranty does not limit or replace your statutory rights.


8. Warranty (liability for defects)

Check upon receipt: Please check the delivered goods immediately upon receipt for completeness, correctness and integrity. If you notice any defects, we ask you to inform us as soon as possible. This notification has no influence on your legal rights, but will make it easier for us to process them.

Legal warranty: In the event of defects, you are entitled to statutory warranty rights. The warranty period is two years from receipt of the goods.

For customers in the European Union, the statutory warranty rights apply without restriction, including the applicable statutory burden of proof rules in favor of the consumer.

Exclusions: Excluded from the warranty are damages caused by improper handling, storage or use of the goods. Failure to achieve the desired health improvement does not constitute a material defect as long as the product is of perfect quality and corresponds to the specified specifications. Our voluntary 90-day money-back guarantee may apply here (Section 7).

9. Subscriptions (“Subscription Model”) & Discount models

9.1 Item and discount model

For all bundles, the customer can take out a subscription with a monthly, 3-monthly or 5-monthly delivery frequency.

The discount model is staggered as follows: - First delivery: Regular individual price (no subscription discount). - Second delivery: 20% discount on the individual price. - Third and every additional delivery: 10% discount on the individual price.

To simplify matters, the discount is distributed evenly: an early partial discount of 10% is granted for the first delivery, which is offset against the discount for the second delivery. As a result, the customer pays an equal amount for each delivery (unit price less 10%).

9.2 Start, term and early discount

The subscription starts with the first delivery and runs indefinitely. Since the 10% discount granted for the first delivery economically represents an anticipation of the discount for the second delivery, if you cancel before the second delivery, the difference between the regular unit price and the amount actually paid will be due. This is not a contractual penalty, but rather payment of the contractually agreed unit price for the first delivery.

9.3 Administration and change

The customer can adjust the delivery interval, delivery address and means of payment at any time in the customer portal or communicate changes by email to hallo@revitera.ch. Changes will take effect in the next delivery cycle, provided they are received no later than 14 calendar days before the planned shipping date.

9.4 Payment methods and charges

Subscriptions are only possible with credit card or PayPal. The payment method stored will be automatically charged for each subsequent delivery shortly before dispatch; the customer receives a payment confirmation by email.

9.5 Termination and notice period

Cancellation can be declared in the customer portal or by email and will take effect at the end of the current delivery cycle if received at least 14 calendar days before the shipping date.

9.6 Automatic renewal

Without effective cancellation, the subscription is automatically extended by the delivery interval selected.

9.7 Price and condition changes

We may adjust prices or discounts as appropriate. Changes will be communicated by email at least 30 days before they come into effect. The customer can terminate within this period with immediate effect (special right of termination).

9.8 90-day money-back guarantee on subscriptions

The guarantee regulated in section 7 applies exclusively to the first delivery of a subscription. After receipt of the second delivery, there is no longer any entitlement to this voluntary service.

9.9 Combination with further discounts

Subscription discounts cannot necessarily be combined with other promotions; The conditions stated in the shop are decisive.


10. Liability

Contractual and non-contractual liability: Alparis is liable without limitation for damage caused intentionally or through gross negligence, as well as for damage resulting from injury to life, body or health. In the event of slight negligence, Alparis is only liable for the violation of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.

Disclaimer: To the extent permitted by law, we exclude any further liability. In particular, we are not liable for indirect or consequential damages.

Product information: Our products are dietary supplements and not medicines. We make no promises of healing. Statutory product liability remains unaffected.

Liability for external links: We assume no liability for the content of linked third-party websites. If we become aware of any legal violations, we will immediately remove such links.

Force majeure: We are not liable for delivery delays due to force majeure (natural disasters, pandemics, official orders, etc.). In such cases the delivery period is extended appropriately. Payments already made will be refunded in the event of cancellation.


11. Data protection

12. Use of AI and automated systems

We can use data protection-compliant automated systems to support internal processes and customer communication. All decisions that affect the rights or interests of customers are always checked and taken responsibility for by a human employee. 13. Changes to the General Terms and Conditions

Alparis reserves the right to adapt these terms and conditions with effect for the future if this becomes necessary due to legal changes or changes to the business models. The current version is published on our website. The terms and conditions apply to your order at the time of ordering.

Subscription customers will be notified of any material changes in a timely manner and will have the right to cancel the subscription before the change takes effect.


14. Final provisions

Applicable law

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict of law reference norms.

The following applies to consumers with habitual residence in the European Union: The choice of law does not result in the consumer being deprived of the protection granted to him by the mandatory provisions of the law of his country of residence. In particular, the mandatory consumer protection regulations of the country in which the consumer has his or her habitual residence remain unaffected.

Jurisdiction

For merchants and other entrepreneurs, to the extent permitted by law, the exclusive place of jurisdiction is the registered office of Alparis GmbH in 8598 Bottighofen, Switzerland.

The statutory places of jurisdiction apply to consumers. Mandatory legal jurisdiction regulations, in particular those in favor of consumers (namely Articles 17, 18 of Regulation (EU) No. 1215/2012 and the Lugano Convention), remain unaffected. Consumers residing in the EU can also bring legal proceedings at their local court.

Place of performance

The place of performance for all obligations is the headquarters of Alparis in Bottighofen, Switzerland, to the extent permitted by law.

Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Severability clause

If individual provisions of these General Terms and Conditions are or become ineffective in whole or in part, the effectiveness of the remaining provisions remains unaffected.
